Overview
Sim Chahal is a commercial litigation attorney who represents individuals, businesses, and institutional clients in complex disputes and transactional matters. His practice focuses on commercial litigation and alternative dispute resolution, with an emphasis on results-driven advocacy and strategic case management.
Prior to joining Fuerst Ittleman David & Joseph, Sim practiced law for over a decade in Toronto, Ontario, where he represented clients before the Ontario Superior Court of Justice, Ontario Court of Justice, and Ontario Court of Appeal, as well as various regulatory tribunals. His extensive experience includes advising clients on high-value commercial transactions, providing trusted counsel to businesses navigating complex financial and contractual matters, and managing a mortgage and loan enforcement cases. Sim is licensed to practice law in both Ontario and Florida.

Representative Matters
- Served as general counsel to a financial institution regulated by the Ontario Securities Commission in connection with the registration and enforcement of residential mortgages.
- Enforced mortgages on behalf of a syndicated mortgage fund, by representing client in default proceedings, foreclosure actions, and negotiations to resolve outstanding financial obligations.
- Served as a legal advisor to a builder on a multi-million-dollar commercial development and construction project in the Greater Toronto Area.
- Successfully represented multiple purchasers to secure specific performance and damages against a residential builder who refused to convey title to properties.
- Preserved the settlement of a mortgage debt exceeding $6 million before an appellate court and obtained a substantial attorney’s fee award on behalf of the client.
- Counseled a small business in negotiating a national supply agreement with a multinational retailer.
- Represented judgment creditors in successfully securing unsecured debt against debtor assets in multiple jurisdictions.
- Obtained urgent injunctive relief to safeguard trust property and prevent dissipation of assets by a trustee.
- Represented parties in franchisor-franchisee disputes involving statutory claims under the Arthur Wishart Act and related contractual issues.
